Terms and Conditions: 

"Teacher" and "I" is Allison Nimlos and Greater Than Counseling and Coaching, LLC.

"Student" and "You" is the User purchasing a program.

"Program" is any and all Course, Community or Membership to which the Student enrolls in. 

By signing this, you are acknowledging that: 
 

1. As Teacher, I am providing information, education, and accountability about behavior change and diabetes education as it pertains to the course you are enrolled in, and NOT as medical or mental health professional NOR for the treatment of a mental health or medical diagnosis. 

2. Programs are not personalized to the needs of the individual and contains information that can be broadly applied to the management of type 1 diabetes or insulin-users with the goal of making mindset and behavioral changes to aid in their wellness. 

3. As the Teacher, I responsible for providing factual, evidence-based information and education. I am not responsible for any and all outcomes based on the information provided. 

4. I agree to maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics). I am also required by law to follow the laws and rules of the Minnesota Board of Marriage and Family Therapy, although I am not conducting psychotherapy within this student-teacher relationship. It is recommended that the Student review the ICF Code of Ethics and the applicable standards of behavior. 

Limitations of Work 

Programs are NOT a replacement for medical or mental health care by licensed professionals in the Student's jurisdiction. 

At no point is the Teacher or any of the services, programming, materials, products, written or verbal communication intended to diagnosis or provide treatment for a mental health diagnosis or a medical diagnosis. 

1. You may not use any course for treatment of any mental health illness, such as depression or anxiety, and any therapeutic benefit derived from coaching is purely incidental. If you find yourself in need of treatment for a mental health and/or psychiatric condition, you will seek out the services of a licensed professional in your jurisdiction (state, country, etc).

2. You remain under the care of licensed medical professionals for any and all medical concerns, including but not limited to type 1 diabetes, type 2 diabetes, pregnancy, hypothyroidism, celiac disease, etc. 

3. You remain under the care of licensed mental health professionals for any and all mental health concerns, including but not limited to major depressive disorder, generalized anxiety disorder, bulimia, binge eating disorder, phobia, or any diagnosable mental health illness listed in the DSM. 

4. Except as expressly provided in this Agreement, the Teacher makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Teacher be liable to the Student for any indirect, consequential or special damages. Notwithstanding any damages that the Student may incur, the Teacher's entire liability under this Agreement, and the Student's exclusive remedy, shall be limited to the amount actually paid by the Student to the Teacher under this Agreement for all educational services rendered through and including the termination date. 

5. By participating in a program, you agree to release, indemnify and hold harmless from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs that may arise from your participation. 

Student Responsibility 

1. You assume full responsibility for results and outcomes. 

2. You assumes sole responsibility for deciding on and implementing behavioral and diabetes management changes, and agree to discuss and verify any and all proposed changes to the treatment of your diabetes or other health conditions with the licensed medical professional responsible for your medical care prior to making those changes. 

3. You understand that to receive the most benefit from a program they will need to participate in all course material, complete all course material, participate in any available office hours, and send emails with questions. The Teacher is not responsible for managing or overseeing the completion of materials and assumes that Student will be self-directed. 

4. You are solely responsible for producing any and all results during and after the program. 

5. You understand that in order to enhance the Student-Teacher relationship, the Student agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program. 

6. Any changes made to diabetes management are of your own volition, and you waive any liability to the Teacher or Company or any adverse events, such as hypoglycemia and hyperglycemia, that may occur.

Cancellation Policies for Courses:

Due to the digital nature of the materials, no refunds will be provided for a course, but the Teacher will do everything in her power to address any concerns of the Student, within reason. 

Cancellation Policies for the Mindful Diabetes Membership:

Cancellation and refunds are available for the first 14 days after the membership period starts, except in the case of the month-to-month membership in which cancellations are only available for the first 7 days. 

Intellectual Property: 

In participating in any program, you may receive video trainings, handouts and worksheets. These are intellectual property that belong solely to Allison Nimlos and Company and are not to be distributed outside of the coaching relationship to anyone. Any release of intellectual property to those outside of the program will cause an immediate dismissal from the program and forfeiture of payment. 

Entire Agreement 

This document reflects the entire agreement between the Teacher and the Student, and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Teacher and the Student. Dispute Resolution If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Teacher and Student agree to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party. Severability If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. 

Waiver 

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement. 

Applicable Law 

This Agreement shall be governed and construed in accordance with the laws of the State of Minnesota, without giving effect to any conflicts of laws provisions. 

Binding Effect 

This Agreement shall be binding upon the Student purchasing the program.
